OFFICIAL CONTEST RULES AND REGULATIONS

{THE CONTEST AND THE CONTEST PERIOD}

The NTV Weather Photo Contest (the “Contest”) commences at 9:00 AM Monday February 26, 2024 and concludes at close of business (7 PM NL Time) on Wednesday April 10, 2024 (the “Contest Period”). 
The Grand Prize draw will be made “live” during the NTV Evening NewsHour on Monday April 15, 2024.

1. NO PURCHASE NECESSARY

2. ELIGIBITY

This Promotional Contest is open to residents of Newfoundland and Labrador ONLY, who have reached the age of majority (19 years NL).

The Contest is not open to employees, directors and officers of NEWFOUNDLAND BROADCASTING, or any of its affiliates. In addition employees, directors and officers of the Sponsors, and their employees, directors and officers of their respective advertising and promotional agencies and any immediate family members of any of the foregoing are not eligible to enter.

3. HOW TO ENTER

To enter The NTV Weather Photo Contest, you may enter online, mail or hand deliver only one photograph no more frequently than once per day of the Contest.
The Photograph must have been taken by you.
The photograph must depict a Newfoundland and Labrador weather related scene. Multiple photos from the same individual on the same day are not permitted (determined by the Company from the information).  See LIMITATION ON NUMBER OF ENTRIES PERMITTED below Rule 9.

4. HOW TO WIN

All qualifying entries received during the Contest Period are eligible for the Grand Prize draw which will be made on Monday April 15, 2024 during the NTV Evening Newshour.  A qualifying entry is an entry that complies with Rule 3 and Rule 8.

All entries must include the entrant’s first and last name, their complete mailing address and telephone number.
A valid return email address is also required on all emailed entries.
Entries that do not contain the information, as listed above, will be destroyed and declared ineligible.
Entries will only be accepted until close of business (7 PM NL Time) on Wednesday April 10, 2024.  Entries received after the deadline will not be entered into the draw.

5.  THE GRAND PRIZE

The Grand Prize winner for the NTV Weather Photo Contest will be determined by a random draw conducted during the NTV Evening News Hour on Monday April 15, 2024 from all of the qualifying entries received during the Contest period.

The first name drawn from the eligible contest entries will be the winner of the grand prize.

The name of the winner will be announced immediately following the “live” draw during the NTV Evening News Hour on Monday April 15, 2024.

The Prize will consist of:
One only 2024 Subaru Outback Wilderness Edition
Colour:  White

6. PRIZE VALUE

The approximate retail value of the Grand Prize is $47,500 plus tax.

The prize must be accepted as awarded. There will be no exceptions.
The winner will need to claim the grand prize at the Capital Subaru dealership on Kenmount Road in St. John’s, Newfoundland and Labrador. It will be the sole responsibility of the winner to pick up the vehicle from that dealer location.

7. AWARDING OF THE GRAND PRIZE

NEWFOUNDLAND BROADCASTING will contact the winner by telephone or email within 48 hours to confirm their identity. In order to be eligible to claim the prize, the winner must correctly answer a 4 part mathematical skill testing question within a 5 minute time limit, which can be done by telephone. In order to claim the grand prize, the winner will have to provide two pieces of identification which will include their full name and full address. The winner must also provide the email address they included with their online entry, when they pick up their prize. If the entrant can confirm that information, they will be awarded the prize associated with the contest.

8. DEADLINE FOR CLAIMING GRAND PRIZE

The Grand Prize winner must claim the Grand Prize within 7 business days of winning and being notified that they have won.

Winning entrants must be 19 years of age or older.

9. LIMITATION ON NUMBER OF ENTRIES PERMITTED

Only one entry per day per individual is permitted. More than one entry each day makes all entries from that individual not eligible for that day’s entries. However, an entry may (but is not required to) be made by the same individual on each day of the Contest and all entries in compliance with these rules and received will be eligible to win.

Entries are subject to verification and any particular entries from the same individual in a single day shall be declared invalid for that day and destroyed if there is more than one entry submitted for that day by the same person.  Moreover entries that are reproduced, falsified, altered, tampered with or the copyright does not belong to the person claiming to have taken the photograph will be destroyed and declared ineligible.

10. CHANCES OF WINNING

Chances of winning will depend on the number of qualifying entries received and then entered into the prize drum.

11. NO REPRESENTATIONS OR WARRANTIES

NEWFOUNDLAND BROADCASTING does not make any representation or offer any warranty, express or implied, as to the quality or fitness of the Prize. The Prize winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from NEWFOUNDLAND BROADCASTING should the Prize fail to be fit for its purpose or is in any way unsatisfactory to the Prize winner, or is subject to forfeit by the winner.

12. DECLARATION AND RELEASE OF GRAND PRIZE WINNER

Before being awarded the Grand Prize the winner will sign a standard form confirming that by entering the Contest: he or she read, understood and accepted these rules and regulations; that he or she understands that acceptance of the prize may involve danger and/or exposure to risks and hazards of both man-made and natural origin, whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, he or she may suffer damage to personal property, serious personal injury, illness or even death; that he or she nevertheless freely and voluntarily agrees and does hereby assume any and all risks of personal injury, illness, death arising out of or connected with his or her participation in the Contest and winning the prize, and that he or she releases NEWFOUNDLAND BROADCASTING, the Affiliates, the Sponsor(s), and all of their directors, officers, employees, agents as well as their respective advertising and promotional agencies (collectively, the “Releases”) from any and all liability arising in connection with participation in the Contest and acceptance of the prize, including, without limitation, any financial, legal or moral responsibility or loss or personal injury including death or damage to or loss of property suffered or incurred or arising from participating in the Contest or accepting the prize, whether suffered by the Prize winner or his or her heirs, administrators, personal representatives or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence or gross negligence of any or all of the Releases.

13. PRIZE TO BE ACCEPTED AS AWARDED

The decision of the Contest judges is final, and the prize must be accepted as awarded. No portion of the Prize is transferable. The Prize is not redeemable for cash and no substitute for any portion of the Grand Prize is offered. Should the Grand Prize winner be unable to claim the Grand Prize as awarded, his or her entry will be forfeited and another eligible Contest entrant will be selected.

14. SUBSTITUTION OR CHANGE TO THE CONTEST

NEWFOUNDLAND BROADCASTING, the Sponsor(s) and their respective advertising and promotional agencies reserve the right to substitute the prize or any component thereof, for those of approximately the same value and reserve the right to change the Contest rules or terminate or withdraw the Contest at any time, without prior notice.

15. OWNERSHIP OF ENTRIES

All entries shall become the property of NEWFOUNDLAND BROADCASTING, the Sponsor(s) and their advertising and promotional agencies. The Releases assume no responsibility for lost, stolen, destroyed or otherwise indecipherable entries due to any failure or technical malfunction in delivery by mail, email or any other electronic means, on-line computer systems equipment, servers, access providers, software, poor reception, technical problems, failure of any email or submission or due to any other reason regardless of cause.

16. CONSENT TO USE OF PERSONALITY

By entering the Contest, each entrant, the Grand Prize winner, consents to the use of his or her name, city of residence, photograph, voice, likeness, image or any other aspect of his or her personality for any publicity and programming purposes, commercial or otherwise, in all media used by NEWFOUNDLAND BROADCASTING, the Sponsor(s), promoters and their advertising and promotional agencies, without any payment or compensation. The winner further agrees that his or her audio reaction may be used for on-air promotional purposes.
Prize winners understand and acknowledge that NEWFOUNDLAND BROADCASTING may contact him or her on-air without prior knowledge as a result of his or her participation inthe Contest.

17.  COPYRIGHT WAIVER

Each evening, Monday – Friday, between 5:30 PM and 7:00 PM, two weather contest entry photos will be selected for broadcast.  One of the two selected  will be broadcast in the First Edition original broadcast weather segment and the other will be included in the original broadcast of the weather segment of the NTV Evening Newshour.  The ‘selected photos’ will be chosen each day up to close of business (7 PM NL Time) onWednesday April 10, 2024 from the new entries to the weather photo contest received on that date. The decision of the Company as to the photos selected is final.

Contest entrants retain the copyright in their submitted work(s). By entering the Contest, entrants grant an irrevocable, perpetual, worldwide non-exclusive license to Newfoundland Broadcasting Company Limited / NTV, to reproduce, distribute, display, and publish the submitted work(s), at its sole discretion, and to create derivative works based on the submitted work(s), in any media now or hereafter known. Each contest entrant warrants that he/she is the sole owner of the copyright in the submitted work(s) and that it has the authority to grant the foregoing licence.  Entrants waive their “moral rights” in the submitted work(s).

18. CONSENT TO COLLECTION AND USE OF PERSONAL INFORMATION

By entering the Contest and voluntarily providing personal information including, but not limited to, name, address, city, email address, home and office telephone numbers (the “Registrant Information”), each Contest entrant grants permission to NEWFOUNDLAND BROADCASTING and the Sponsor(s) to the collection and use of the Registrant Information for the exclusive purpose of administering the Contest and selecting the Prize winner.
No correspondence will take place between NEWFOUNDLAND BROADCASTING, the Sponsor(s) and the entrants other than in connection with the Contest and, in the case of the Prize winners, as a result of entering the Contest and winning the Grand Prize.

20. COMPLIANCE WITH CONTEST RULES

All Contestants agree to abide by the Contest Rules, which are subject to change at the sole discretion of NEWFOUNDLAND BROADCASTING and the Sponsor(s).

21. COMPLIANCE WITH LAWS

This Contest is void where prohibited by law, and is subject to all federal, provincial, territorial and municipal laws and regulations of Canada and of each province, territory and municipality of Canada, respectively.
